Diminution in Value Assessments

We regularly receive instructions from solicitors to provide advice in both the residential and commercial spheres where a client feels he has received incorrect advice from a professional advisor. Generally, instructions are in relation to residential property where, for example, a purchaser relies upon a negligent survey report where a defect requiring repair has not been drawn to their attention. Occasionally, part of the plot is incorrectly conveyed or a right of way not drawn to the purchaser’s attention. In such scenarios we can provide independent advice and if an agreement cannot be reached, follow the case through to Court.

Expert Witness

A number of our surveyors are members of the RICS Expert Witness Registration Scheme (EWRS) and regularly provide advice in both the residential and commercial spheres upon various property related disputes. We regularly provide advice to a Court as a single joint expert, where our duty is to the Court to provide independent and impartial advice. However, there are times when our experts have to appear in Court and all our surveyors who are members of the EWRS have done so successfully.

In order to be a member of the Expert Witness Registration Scheme individual recommendation is required together with full knowledge of the Civil Procedure Rules and the RICS document “Surveyors acting as Expert Witnesses”.

Retrospective Valuations

In these difficult economic times, lenders are increasingly seeking to recover losses sustained on property loans.

Using our extensive knowledge of both the residential and commercial markets, we are able to undertake retrospective valuations in order to assess whether a surveyors valuation was excessive, or if not, within an acceptable range.

Expert Determination and Arbitration

Many rent reviews in commercial property leases contain a provision that the new rent is to be determined by a third party in the event of a dispute. A number of our commercial valuers are members of a select panel of arbitrators regularly receiving appointments from the President of the Royal Institution of Chartered Surveyors.
